The following are comments made by Dr. Madison Thomas. Dr. Thomas was the original Board chairman and developed the enabling laws and initial drafts of the guidelines. He has been a member of the Medical Advisory Board since that time, except for short intervals when he was called for service out of state. As chairman, he has been succeeded by individuals highly respected in the medical profession, and there has been close cooperation between the Board and the administrative staff of the Driver License Division.

FUNCTIONAL ABILITY IN DRIVING &
THE DRIVER LICENSE MEDICAL ADVISORY BOARD

Prior to 1979, Earl N. Dorius was responsible for driver licensing for the state of Utah. He found that individuals would, from time to time, object to his conclusions, since they were based on individual recommendations of physicians, without any specific criteria to rely on.

In one instance, a neurosurgeon had made the statement that if a person had ever had even one seizure, he would never drive again, as far as he was concerned.

When these individual requests came in, Mr. Dorius invited individual physicians to come, and this usually included Dr. Chester Powell and Dr. Madison Thomas of Salt Lake City, and Dr. Moore from Ogden. In these situations, they would talk with the driver who had requested consideration and make the best sort of judgment they could.

In 1979, legislation was drafted to create a driver license medical advisory board. This was after making some concessions to a group of individuals who had permanent handicaps. The bylaws of the Advisory Board provide that one member of the executive committee and one of the expert members may evaluate individual cases, but in subsequent years, it has been found that there has been significant overlap of more than one condition involved, so that at monthly intervals, the full Driver License Medical Advisory Board meets to review individual cases. Frequently, additional information may be requested for review. Not infrequently the final action is deferred pending a driving test, conducted by experienced driving test examiners. Based on the basic concept that a physician should to do whatever he could to increase the functional ability of individuals under his care, this basic concept of functional ability was used in devising guidelines for physicians and other health care practitioners.

Thus "Functional Ability in Driving" was developed as guidelines for practitioners and other health care providers to use in reporting what was appropriate for driving.

Since then thousands of drivers have been given limited privileges to drive within their functional ability. Often this would eliminate any nighttime driving, limited speeds, eliminating freeway driving or allowing driving within a limited radius. Many of these individuals have been able to go to their grocery store, go to work, go to visit friends or go to their church, within the limits of these functional ability guidelines.
