Some states have already passed laws prohibiting hand-held cell phone use and texting while driving. And these laws, in many instances, criminalize some of the actions of drivers using a phone. However, as Dr. Daniel McGehee recently pointed out in a an article in the latest Highway to Justice, a publication of the American Bar Association and the National Highway Traffic Safety Administration, law enforcement personnel face difficulties when investigating whether mobile phone use was a contributing factor in a car crash.
